What is a deposition and do I have to give one?
A deposition is sworn out-of-court testimony taken by the opposing attorney during the discovery phase of your lawsuit. In Georgia, if you are a party to a lawsuit or a material witness, you are generally required to appear and testify when properly noticed under O.C.G.A. § 9-11-30. Refusing to appear can result in sanctions or contempt.
